Public Batch Portal Terms

These terms govern access to a public Batch Product Portal reached through an Evergreen Scan QR code or link. By using a Portal, you agree to these terms.

1. What the Portal provides

A Portal may display Brand, Product, Batch, COA, laboratory, terpene, media, game, recommendation, and purchase-destination information configured by an Evergreen business customer. Portal content can change, and a Batch may later be marked Voided or unavailable.

2. Important Product limitation

Customer-supplied Product and compliance content is the responsibility of the Brand that publishes it. Evergreen does not independently test, certify, approve, endorse, or guarantee a Product's authenticity, safety, legality, potency, efficacy, quality, laboratory results, or regulatory compliance. A recognized QR destination is not government, laboratory, or safety approval.

Do not rely on a Portal as medical, legal, dosage, impairment, or emergency advice. Follow the Product label, applicable law, and advice from qualified professionals.

3. Regulated Products and external purchases

Some Portals concern cannabis, hemp, or other regulated Products. You are responsible for complying with age, possession, purchase, use, transport, and location restrictions. Evergreen does not sell or deliver regulated Products. A Product link may take you to an external site operated by the Brand or another seller under its own terms.

4. Portal measurement and privacy

Evergreen records first-party Scan and interaction activity to provide customer Analytics and improve Portal reliability. This may include Scan time, browser user-agent, inferred device/browser category, anonymous session and visitor identifiers, module views, scrolling, media or game milestones, COA opens, and destination clicks. 5. Permitted use

You may view and share a Portal for lawful personal use. You must not:

  • scrape, harvest, copy in bulk, reverse engineer, or interfere with a Portal or its measurement;
  • attempt unauthorized access, introduce malicious code, impersonate another person, or manipulate recorded activity;
  • use Portal content to facilitate illegal sales, fraud, deception, or harm; or
  • reuse Brand content or Evergreen software commercially without permission.

6. Intellectual property and third-party content

Evergreen owns its software, interface, and trademarks. The publishing customer or its licensors own their Brand and Product content. External documents, videos, stores, and other links are controlled by their respective operators.

7. Availability and withdrawal

Portals are provided “as is” and “as available.” Evergreen does not guarantee continuous availability. A customer or Evergreen may correct, suspend, Void, or withdraw a Portal when content is inaccurate, unlawful, unsafe, compromised, or no longer supported.

8. Limitation of liability

To the maximum extent permitted by law, Evergreen is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from Portal use, Product reliance, external links, or unavailable content. Nothing excludes liability that cannot legally be excluded.

9. Governing law and changes

These Portal Terms are governed by South Carolina law. Non-emergency disputes should first be submitted in writing for a 30-day good-faith resolution period. We may update these terms and will revise the date above and provide reasonable notice of material changes.
